Introduction

These Terms of Use are the agreement between you and TVARUS HEALTHCARE GLOBAL PRIVATE LIMITED (“Tvarus”, “we”, “us”), a company incorporated in India, which operates this platform under the name Tvarus Global. They apply to the website, to your patient account, and to every service you reach through them.

Please read them before you use the platform. They set out what we do, what we do not do, and who is responsible for what — which on a medical travel platform matters more than it does on most.

Accepting these terms

By using this platform — browsing it, sending an enquiry, opening an account, or asking us to coordinate a case — you accept these terms. If you do not accept them, please do not use the platform.

Where you use the platform on behalf of somebody else — a patient you are related to, a person you represent, or an organisation — you confirm that you are authorised to do so and to accept these terms for them, and you are responsible for what is done through your account.

Our Privacy Notice explains how we handle personal information, including health information. It forms part of your agreement with us.

What Tvarus is

Tvarus is a coordination and information platform for medical travel. Through it you can compare published information about hospitals, doctors, treatments and indicative costs; send a single enquiry to the hospitals you choose; receive their responses; hold consultations; organise documents; prepare for travel; and stay in contact during and after treatment.

Our role is to organise and carry information between you and the organisations that treat and host you, and to keep the process visible to you. The decisions — which hospital, which quotation, whether to travel, whether to be treated — remain yours.

See how a coordinated journey works

What Tvarus is not

This section is as important as any other in this document.

  • We are not a hospital, a clinic, a doctor, a nurse, a pharmacy or a diagnostic laboratory, and we do not practise medicine.
  • We do not give medical advice, a diagnosis, a prognosis or a treatment recommendation. Information published here is general, and it is no substitute for a consultation with a qualified professional who has examined you.
  • We are not an insurer, and we do not provide, arrange or underwrite insurance.
  • We are not a travel agent, tour operator, airline or hotel. We do not sell, book or reserve flights, hotels or transport.
  • We are not an immigration adviser or a licensed migration agent, and we have no part in any official decision about your travel or your stay.
  • We do not employ, supervise, license or certify the hospitals and doctors listed on the platform. Their presence here is not a recommendation of them by us.

Not an emergency service

The platform is not monitored for emergencies and must never be used to report one. If you or someone with you needs urgent medical help, contact your local emergency number or go to the nearest hospital immediately.

Eligibility and your account

  • You must be 18 or over to open an account. A case for a child, or for an adult who cannot act for themselves, must be opened and managed by a parent, a guardian or a lawful representative.
  • You must give accurate information and keep it current. Coordination, medical opinions and travel preparation are built on what you tell us, and an inaccuracy can cost a treatment date.
  • Sign-in uses a single-use code sent to your registered address. Keep access to that address to yourself, never pass a code to anybody, and tell us at once if you think somebody else has reached your account.
  • You are responsible for activity carried out through your account, except where it results from a failure on our side.
  • We may ask you to confirm your identity before acting on a request that affects a case, a payment or a document.

How the platform works

A coordinated journey moves through the same stages for everybody: an enquiry, preparation of your case, review by the hospitals you choose, your decision, travel and visa preparation, treatment, discharge and return, and follow-up afterwards.

Nothing moves without you. We do not send your records to a hospital you have not selected, we do not accept a quotation on your behalf, and we do not commit you to a date, a treatment or a payment.

Information published on this platform

  • Hospital and doctor profiles set out what those organisations state about themselves, together with entries drawn from public registers. We record what is stated; we do not independently check clinical quality, and publication here is not our endorsement.
  • Treatment and care-area pages carry general information to help you ask better questions. They are not clinical guidance, and they do not describe your case.
  • Ordering, filters and suggestions in the directory are conveniences for comparison. No hospital pays for its position, and no result is a recommendation of one provider over another.
  • Availability, credentials, facilities, contact details and prices change. Confirm anything that matters to your decision with the hospital itself before you rely on it.

Estimates, quotations and prices

  • Figures shown on the public pages are indicative estimate ranges. They are not offers, they are not quotations, and they are not a promise of what you will pay.
  • A quotation sent to you by a hospital is that hospital’s own document, on its terms and for its stated validity. It governs over anything shown here.
  • A final bill depends on findings, complications, length of stay and choices made during treatment. It can differ from any estimate or quotation, and that difference is a matter between you and the hospital.
  • Where an amount is shown converted into another currency, the conversion is indicative only. The hospital’s own currency, and the rate applied on the day you pay, decide the real amount.
  • Costs outside a hospital’s quotation — travel, accommodation, food, local transport, an attendant’s expenses, insurance — are yours unless a written agreement says otherwise.

Consultations and clinical responsibility

  • Every clinical judgement is made by the treating hospital and its doctors. They alone are responsible for the opinion they give, the treatment they provide, and its outcome.
  • An opinion obtained through the platform is given remotely, usually without a physical examination, on the records supplied. It is not a treatment plan, and it may change once you are examined.
  • We do not review, endorse, overrule, correct or interpret a clinical opinion, and we cannot tell you which advice to follow. If two opinions differ, that is a question for a qualified professional, not for us.
  • A consultation is a scheduled appointment with a doctor. Taking part, recording, and any transcription or translation are asked for separately, and recording stays off unless you agree to it.
  • No clinical outcome is promised anywhere on this platform, by us or on any hospital’s behalf.

Fees, payments and refunds

  • The platform charges for the services it provides itself — principally the consultation fees shown to you before you pay. The amount, the currency and what it covers are stated on the payment screen, and nothing is charged without that step.
  • The cost of treatment is payable to the hospital, on the hospital’s terms, and not to us. We do not hold treatment funds and we do not act as an escrow.
  • Payments are processed by a payment provider. A payment is complete when the provider confirms it; a pending or failed authorisation does not secure an appointment.
  • Where a fee is refundable, the terms are stated at the time of payment. A refund is returned to the original payment method, and the provider’s and your bank’s timelines apply.
  • Taxes and charges required by law are added where applicable. Charges applied by your own bank or card issuer, including currency conversion costs, are yours.
  • If you believe you have been charged in error, write to us with the payment reference and we will investigate.

Documents and information you provide

  • You confirm that you are entitled to give us the documents and information you upload, including where they relate to another person you represent.
  • Send what is asked for. Uploading more than that does not speed anything up, and it increases what is disclosed.
  • We may refuse, quarantine or remove a file that is unsafe, unreadable, or plainly not what it claims to be.
  • Documents are shared as described in the Privacy Notice: with the hospitals you select, in stages, and for the purpose you agreed to.
  • Deliberately supplying false identity, medical or travel information may end your access to the platform, and may have consequences under the law of the country concerned.

Visa, travel and stay

  • We help you get ready: explaining what a mission usually asks for, organising the papers a hospital issues, keeping your dates and documents together, and pointing you at official sources.
  • We do not apply on your behalf. We cannot influence, hurry or predict a decision, and we cannot promise that a visa will be granted or that a journey will be permitted. That decision belongs entirely to the authorities of the country concerned.
  • We do not sell or book flights, hotels or ground transport. Where a partner provides those services, you contract with that partner on its own terms.
  • You are responsible for meeting the entry, health, insurance and stay requirements that apply to you, and for leaving within the period your permission allows.
  • Only the official sources of the country concerned are authoritative. Check them, and check them again close to your travel date.

Acceptable use

The platform carries other people’s medical information and other organisations’ work. Use it accordingly. You must not:

  • impersonate another person, or open an account for someone whose authority you do not have;
  • give false identity, medical, financial or travel information;
  • attempt to reach an account, a case, a document or a part of the system you have not been given access to;
  • copy, scrape, harvest or republish content, listings or contact details from the platform, by hand or by automated means;
  • use the platform to advertise, to solicit patients, to recruit or to sell;
  • upload anything unlawful, infringing, malicious or deliberately misleading;
  • probe, disrupt, overload or attempt to circumvent the platform’s security, rate limits or access controls;
  • reverse engineer, decompile or attempt to derive the source of the platform, except so far as the law expressly allows;
  • abuse, threaten or harass our staff, a hospital’s staff, a partner or another user.

Your content, and our intellectual property

  • What you send remains yours. You give us the permission we need to store it, process it and pass it on as you direct, so that we can provide the service — and no more than that.
  • The platform itself — its software, design, structure, text, illustrations and arrangement — belongs to us or to our licensors, and is protected by law.
  • Hospital names, logos, marks and profile content belong to those organisations. They are shown here with them; they are not transferred to us.
  • Nothing in these terms grants you a licence to use our name, our marks or the platform’s content for any other purpose without our written permission.

Third-party services and links

Parts of the journey run on services provided by others: a video consultation platform, a payment provider, email, SMS and WhatsApp delivery, mapping, and machine translation on public pages. Following a link, joining a consultation or making a payment brings you within that provider’s own terms and notice.

We choose providers with care and contract with them, but we do not control their services, and we are not responsible for the content of an independent site you reach from a link here.

Availability, changes and suspension

  • We aim to keep the platform available, but we do not promise uninterrupted service. Maintenance, faults and events outside our control do happen.
  • We may add, change or withdraw features. Where a change materially affects a live case, we will tell the people it affects.
  • We may suspend or limit access where these terms are breached, where security or another person’s safety requires it, or where the law obliges us to.
  • Suspending an account does not by itself end a hospital’s obligations to a patient already in its care, and it does not entitle us to keep a fee for a service we have not provided.

Ending your use

You may stop using the platform at any time and ask us to close your account. Closing an account does not delete records we are required to keep, and does not by itself end an arrangement you have made with a hospital or another provider.

Provisions that by their nature should outlast your use — fees already due, the limits on liability, intellectual property, and governing law — continue to apply afterwards.

Disclaimers

So far as the law allows, the platform and its content are provided as they are and as available, without warranties of any kind, express or implied.

  • We do not warrant that published information is complete, current or free of error, nor that a hospital will accept a case, offer an appointment, hold a price, or be available on your dates.
  • We give no warranty on any clinical matter — the suitability, safety, quality or outcome of any treatment, opinion, doctor or facility.
  • We do not warrant that the platform will be uninterrupted, secure against every attack, or free of defects.

Nothing in this section limits a right you have under a consumer-protection law that cannot be excluded by agreement.

Limitation of liability

  • We are not liable for the acts, omissions, advice, treatment or outcomes of a hospital, a doctor, a service partner, a carrier or any other independent provider, nor for a decision taken by an authority.
  • We are not liable for indirect or consequential loss, or for loss of profit, revenue, opportunity, data or reputation.
  • Where we are liable to you, our total liability arising out of your use of the platform is limited to the fees you paid to us in the twelve months before the event giving rise to the claim.
  • Nothing here excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by our negligence, or for fraud.

Indemnity

You agree to hold us harmless from claims, losses and reasonable costs arising from your breach of these terms, from information you supplied that was false, or from unlawful use of the platform through your account. This does not apply to the extent that the loss was caused by us.

Complaints

If something goes wrong, tell us. Write with what happened, the case or payment reference, and what you would like done. We will acknowledge it, look into it, and reply with an outcome.

A complaint about clinical care must also be raised with the hospital that gave the care. It is the only organisation able to answer it, and the only one with the record of what was done.

Governing law and jurisdiction

These terms, and any dispute arising out of them or out of your use of the platform, are governed by the law of India. The competent courts in India have jurisdiction over such a dispute, and you and we submit to them.

Where the law of the country you live in gives you a right to bring proceedings there, that right is unaffected.

Changes to these terms

These terms are versioned and effective-dated; the version and date shown at the top of this page are the ones in force. We may change them to reflect a new feature, a change in the service, or a change in the law. Where a change materially affects you we will bring it to your attention, and continuing to use the platform after it takes effect means you accept it.

General

  • If any provision is found unenforceable, the rest continues in force, and that provision is read down to what is enforceable.
  • A failure to enforce a term is not a waiver of it.
  • Nothing here creates a partnership, agency, employment or joint venture between you and us, and nothing makes us a party to your agreement with a hospital.
  • You may not transfer your rights under these terms. We may transfer ours to a successor of our business, provided your rights are not reduced by the transfer.
  • These terms, together with the Privacy Notice and anything expressly incorporated into them, are the whole agreement between you and us about the platform.
  • They are published in English. Where a translation is offered for convenience and disagrees with the English text, the English text governs.
